Hotel and Lodging House Rates (Control) Act,1947
Landlord can
file a suit against the tenant on grounds of non-payment of the standard rent or permitted
increases.
As per Section 12(2) of the Act, a landlord can file a suit against his tenant on the
grounds of non-payment of standard rent and permitted increases due to him. However, he
can do so only after the expiration of a period of one month after serving a notice in
writing of the amount due from the tenant. The notice has to be served in the manner
provided in Section 106 of the Transfer of Property Act, 1882.
