available to a tenant if a suit for eviction has been filed against him:
As per Section 12(3) of the Act, the court cannot pass a decree for eviction, if on the
first day of the hearing of the suit or on or before such date the tenant pays in Court
the amount due to be paid by him.
The tenant has to pay such amount together with simple interest on it at the rate of nine
per cent per annum. The tenant also has to continue paying the rent pending the disposal
of the suit, along with cost of the suit if so directed by the court.
